Terms of service

Last updated October 3, 2026Deutsche Fassung
01

Scope and provider

(1) These terms apply to all contracts between Meler/Buturak GbR (Sonosight GbR), Am Eichenpark 25, 30823 Garbsen, Germany, email contact@sonosight.app (“Sonosight”, “we”, “us”) and our customers (“you”) for the use of Sonosight.

(2) Sonosight is offered to consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that predominantly fall outside their trade, business or profession (§ 13 German Civil Code, BGB). A business is a natural or legal person or a partnership with legal capacity that acts in the exercise of its trade, business or profession (§ 14 BGB). Where a provision applies only to consumers or only to businesses, it says so.

(3) Conflicting or supplementary terms of a business customer do not apply unless we expressly agree to them in text form.

02

The service

(1) Sonosight lets you upload audio files or submit ISRCs and links for your recordings. The service creates an acoustic fingerprint of each recording and identifies recordings that match it or are derived from it, for example sped-up, slowed or pitched edits, covers, remixes and re-uploads. It also shows catalog analytics such as playcounts and streaming statistics. The features and limits of each plan are described on our pricing page at the time you order.

(2) Results are generated automatically using third-party recognition services (in particular ACRCloud) and third-party data sources (in particular Chartmetric and Genius). Detection depends on the databases of these providers. We therefore do not guarantee that every derivative recording is found, that every match is correct, or that third-party figures such as playcounts are complete and accurate. Results are for information only. Please check them before you rely on them.

(3) Sonosight does not provide legal advice and does not assert or enforce any rights on your behalf. Whether and how you act on a result is your decision.

(4) We develop the service further and may change features where there is a valid reason, in particular technical developments, security, changes in the law or changes by our third-party providers, and where the change is reasonable for you. The core features of your plan remain. Changes never cost you extra. If a change impairs your access to or use of the service more than insignificantly, we will inform you clearly and in good time in text form. As a consumer you may then terminate the contract free of charge within 30 days (§ 327r BGB).

03

Account and conclusion of the contract

(1) Using Sonosight requires a user account. You can register with an email address and password or through Google, Apple or GitHub. Registration is free. You must be at least 16 years old. If you are under 18, you need the consent of a parent or legal guardian to book a paid plan or buy credits.

(2) When you register, a free user contract on the basis of these terms is concluded between you and us. The presentation of plans and credit packs on our website is not a binding offer.

(3) You order a paid plan or a credit pack as follows. You choose a plan or credit pack on the pricing page or in your account settings and are forwarded to the checkout page of our payment provider Stripe. There you enter your payment details and see a summary of your order. Until you submit the order you can correct your entries at any time, or cancel the order with your browser’s back button. By clicking the button to place your order with an obligation to pay, you make a binding offer. The contract is concluded when we activate your plan or credit the purchased credits to your account. We confirm the contract by email.

(4) The contract languages are German and English. We store the text of the contract. These terms are available at any time on our website, where you can save or print them. The details of your orders are available in your account settings and in the receipts we send by email.

(5) Your account details must be accurate and kept up to date. Keep your login credentials confidential and tell us immediately if you suspect that someone else is using your account. Your account is personal and may not be transferred to others.

04

Prices and payment

(1) The prices shown on our pricing page at the time of your order apply. All prices are final prices. Where we charge VAT, it is included.

(2) Payments are processed by Stripe using the payment methods offered at checkout. Subscription fees are charged in advance at the start of each billing period.

(3) Each plan includes a set number of scans and catalog songs per billing period. You can only exceed this allowance after you have expressly confirmed in the service that you agree to pay for the additional usage. Your confirmation applies to the current billing period. Additional usage is charged at the per-unit prices shown to you before you confirm, and billed with the invoice at the end of the billing period.

(4) Credit packs are one-time purchases. Each credit entitles you to one scan in addition to the scans included in your plan. Credits do not expire as long as your account exists, and they cannot be transferred or exchanged for cash. When your account is closed, we refund unused purchased credits on request, in proportion to the price you paid for them. Credits are used only once the scans included in your plan for the current billing period are exhausted, and before any additional usage is charged. Without a plan, each scan uses one credit.

(5) If a payment fails, we may suspend the paid features of your account until the outstanding amount has been paid. We will notify you before we do so.

(6) We will only change the price of an existing subscription with your consent. We will notify you of a proposed price change in text form at least six weeks before it is to take effect. If you do not consent, your subscription continues at the existing price, and we may then terminate it with the notice period set out in section 5.

05

Term, plan changes and termination

(1) The free user contract runs for an indefinite period. You can terminate it at any time by deleting your account in the account settings or by sending us an email.

(2) Paid plans have a billing period of one month and renew automatically by one further month unless cancelled. You can cancel at any time with effect from the end of the current billing period: in your account settings or in text form by email. [Missing: the cancellation button required for consumer subscriptions (“Verträge hier kündigen”, § 312k BGB) has been removed from the website]

(3) You can switch to a different plan on the pricing page. The change takes effect immediately. The price difference for the remainder of the current billing period is prorated: an upgrade is charged right away, and a downgrade is credited to your next invoice.

(4) We can terminate a paid plan, and the free user contract, with one month’s notice to the end of a billing period.

(5) Both parties’ right to terminate without notice for good cause remains unaffected. Good cause for us exists in particular if you seriously or repeatedly breach section 8 or 9 despite a warning, or if you are in default with payments for two consecutive billing periods.

(6) When a paid plan ends, your account continues as a free account. Your catalog and scan results remain available until you delete them or your account. If you delete your account, any active subscription ends at the same time and your data is deleted as described in our privacy policy. Fees already paid for the current billing period are not refunded unless the law requires otherwise.

06

Right of withdrawal for consumers

If you are a consumer, you have a right of withdrawal as set out below. Businesses have no right of withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Meler/Buturak GbR (Sonosight GbR), Am Eichenpark 25, 30823 Garbsen, Germany, email contact@sonosight.app) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. You can also withdraw using the withdrawal function in your account settings. [Missing: the withdrawal function required since 19 June 2026 (Directive (EU) 2023/2673) is not yet built. Also check this wording against the current statutory model]

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

Early expiry of the right of withdrawal

For a contract for services, the right of withdrawal expires once we have fully performed the service, if we only began performance after you gave your express consent and at the same time confirmed your knowledge that you lose your right of withdrawal once we have fully performed the contract (§ 356(4) BGB).

Your content

(1) You may only upload or submit recordings for which you hold the necessary rights, or for which the rights holder has authorized you to have them analyzed.

(2) You keep all rights to your content. You grant us a simple (non-exclusive), non-transferable and royalty-free right, limited to the term of the contract, to store, reproduce and technically process your content, in particular to create fingerprints, and to transmit it to our service providers, in each case only as far as this is necessary to provide the service. This right ends when you delete the content or your account, except where statutory retention obligations apply.

(3) If third parties assert claims against us because content you uploaded or submitted infringes their rights, and you are responsible for the infringement, you shall indemnify us against these claims, including the reasonable costs of our legal defense.

(4) We grant you a simple (non-exclusive), non-transferable right, limited to the term of the contract, to use the service in accordance with these terms. You may use the results for your own purposes.

(5) Sonosight is not a storage service for your recordings. Please keep your own copies of your files.

09

Acceptable use

When using Sonosight, you must not:

  • upload or submit content that is illegal or that you have no right to have analyzed;
  • access or attempt to access other users’ accounts or data, or our systems beyond the access we give you;
  • disrupt or overload the service or its infrastructure;
  • access the service by automated means such as bots or scrapers, other than through interfaces we provide for that purpose;
  • circumvent usage limits, for example by creating multiple accounts;
  • resell or otherwise make the service available to third parties without our consent;
  • decompile or reverse-engineer the service, except where the law expressly permits this (§ 69e German Copyright Act, UrhG).
10

Notices and content moderation

(1) Anyone can notify us of content on Sonosight that they consider illegal by email to contact@sonosight.app. Please explain why you consider the content illegal, identify it as precisely as possible, and give your name and email address. We confirm receipt, review the notice diligently and objectively, and inform you of our decision.

(2) If content is illegal or breaches these terms, we may block or delete it, or restrict or suspend the account concerned. Before we act, we weigh the circumstances and the interests of everyone involved and, where appropriate, give a warning first. Our moderation decisions are made by people, not by automated systems.

(3) If we restrict your content or account, we tell you why (Art. 17 Digital Services Act, DSA), unless the law prohibits this. You can object by email; we will then review our decision. Your right to go to court is unaffected.

(4) Our single point of contact for authorities, the European Commission and users under Art. 11 and 12 DSA is contact@sonosight.app. You can contact us in German or English.

11

Availability and warranty

(1) We aim to keep Sonosight available at all times but cannot guarantee uninterrupted availability. Interruptions may occur, in particular for maintenance, for security reasons, or because of disruptions outside our control, such as failures of our third-party providers or of the internet. We announce planned maintenance in advance where possible.

(2) The statutory warranty rights apply. For consumers, these are in particular the rules on digital products in §§ 327 et seq. BGB.

12

Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, to the extent of any guarantee we have given, and where we have fraudulently concealed a defect.

(2) In cases of slight negligence, we are only liable for breaches of an essential contractual obligation, meaning an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In that case our liability is limited to the damage that was foreseeable and typical for this type of contract when the contract was concluded. Otherwise we are not liable for slight negligence.

(3) These limitations also apply to the personal liability of our legal representatives, employees and vicarious agents.

13

Data protection

We process your personal data in accordance with our privacy policy.

14

Changes to these terms

(1) We may change these terms for the future, for example when the law changes or when we introduce new features. We will notify you of any changes in text form at least six weeks before they are to take effect.

(2) Changed terms only apply to an existing contract if you agree to them, for example by confirming them in the service. If you do not agree, the contract continues under the existing terms, and we may then terminate it with the notice period set out in section 5.

15

Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in another country, this choice of law does not deprive you of the protection of the mandatory provisions of the law of that country.

(2) If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, or if you have no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this contract is our registered office in Garbsen. Statutory exclusive places of jurisdiction remain unaffected.

(3) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(4) If individual provisions of these terms are invalid, the remaining provisions remain valid (§ 306 BGB).

(5) These terms are available in German and English. The German version is legally binding; in case of discrepancies it prevails over the English version.
